TERMS AND CONDITIONS OF SALE

1. DEFINITIONS
In these terms and conditions of sale, the following terms have the meaning set out below:
- Item: any product offered for sale on the Site.
- Customer: any natural person of legal age, not acting as a trader, with full legal capacity, placing an order on the Site. Minors must hold parental authorisation.
- Order: a commitment to purchase the Items selected by the Customer through the Site’s e-commerce service.
- Site: the website published by M FASHION - MARAISLISE, accessible at www.maraislise.com.
- T&Cs: these terms and conditions of sale.
2. PREAMBLE AND SELLER DETAILS
These T&Cs apply exclusively between any Customer and the company:

The T&Cs apply without restriction or reservation to all Items offered for sale on the Site. The applicable T&Cs are those in force on the Site on the day of the Order. Any Order constitutes unreserved acceptance of these T&Cs.
These T&Cs prevail over any other document. This site is reserved exclusively for sales to private individuals. Any professional wishing to resell our Items is invited to contact us directly.
3. CREATING A CUSTOMER ACCOUNT
Anyone may freely create a customer account, at no cost, via the "Create an account" section. Creating an account allows the Customer to identify themselves before confirming each Order.
When creating an account, the Customer undertakes to provide complete, accurate and up-to-date information, and not to impersonate a third party. Login details and passwords are strictly personal and confidential.
If the Customer suspects fraudulent use of their account, they must contact MARAISLISE immediately to change their login details.
MARAISLISE reserves the right to suspend or close any account in the event of non-payment of one or more previous Orders, after informing the Customer by email with eight (8) calendar days’ notice.
4. ITEM CHARACTERISTICS
The Items available for sale are those shown on the Site, while stocks last. MARAISLISE reserves the right to withdraw any Item from sale on the Site at any time.
If an Item is unavailable after an Order has been placed, the Customer is informed by email and their Order is automatically cancelled. MARAISLISE issues a refund within a maximum of 14 calendar days.
The characteristics of the Items (photographs, descriptions, colours) are provided for guidance only. Only the image displayed at the time of the Order should be taken into account. In the event of an error or omission in the description of an Item, MARAISLISE’s liability is limited to the full refund of the product and of the return costs incurred by the Customer.
5. ORDER
Every Order entails an obligation to pay. The Customer declares that they are at least 18 years old and have full legal capacity or, if a minor, warrants that they hold parental authorisation.
To place an Order, the Customer follows the online purchase process and clicks "Order" to submit their Order. Payment of the Order constitutes acceptance of these T&Cs, of the price of the Items and of the content of the Order.
After payment is validated, MARAISLISE sends the Customer a confirmation email. The Order is only definitively confirmed once the Customer receives an email confirming dispatch of the Item(s).
MARAISLISE cannot be held liable for any input error attributable to the Customer.
6. PRICE
Prices are shown on the Site in euros, inclusive of all taxes, excluding shipping costs. They reflect the VAT applicable on the day of the Order.
Shipping costs are specified on the Site before the Order is confirmed. MARAISLISE reserves the right to change prices at any time; Items are invoiced on the basis of the rates in force at the time each Order is confirmed.
The Customer is informed that prices may vary between the Site and any resellers. This difference cannot be the basis for a refund request outside the right of withdrawal set out in Article 10.
7. PAYMENT
Every Order entails an obligation of immediate payment. The Order is only final once the price and associated costs have been paid in full.
The accepted payment methods are: bank card (CB, Visa, MasterCard, American Express) and PayPal account.
Transactions are processed by the secure payment platform Stripe (info@stripe.com), which encrypts and secures all banking data. MARAISLISE has no access to the Customer’s bank card details.
If they wish, the Customer may securely save their card details with our payment provider to make future purchases easier. The Customer can delete their saved card at any time from their account area.
The invoice, including delivery costs and VAT, is available online in the customer account after the Order has been dispatched.
8. DELIVERY
Items are shipped to the delivery address provided by the Customer when ordering. The Customer is responsible for the accuracy of the delivery information provided.
MARAISLISE offers several delivery methods, whose rates and times are specified on the Site before the Order is confirmed. Please refer to the Shipping Policy available on the Site for the details of options, rates and times by geographic area.
A confirmation email with a tracking number is sent to the Customer as soon as their parcel is dispatched.
9. DELIVERY TIMES
Items are prepared and dispatched within 48 working hours of payment confirmation, excluding weekends and public holidays.
MARAISLISE undertakes to deliver within a maximum of 30 calendar days from the Order.
If this maximum time is exceeded, the Customer may contact MARAISLISE to request delivery within a further reasonable period. If this new period is not met, the Customer may, in accordance with Article L216-2 of the French Consumer Code, terminate the contract by email and obtain a full refund of their Order within 14 calendar days of termination.
10. RIGHT OF WITHDRAWAL AND RETURNS
10.1 Right of withdrawal
In accordance with Article L221-18 of the French Consumer Code, the Customer has 14 calendar days from receipt of their Order to exercise their right of withdrawal, without having to give a reason or pay any penalty.
To exercise this right, the Customer notifies MARAISLISE of their decision to withdraw within this period, by email to hello@maraislise.com or via the Site’s contact form, or using the model withdrawal form available on the Site.
Once their withdrawal has been notified, the Customer has a further 14 days to return the Item(s) concerned.
10.2 Return conditions
Only Items returned in their original condition — new, unworn, unsoiled, with their tags, in their original packaging — are accepted as returns.
Return postage is at the Customer’s expense. The Customer is strongly encouraged to return their parcel by a method that provides proof of dispatch with a confirmed date (tracked parcel service, recorded delivery with acknowledgement of receipt, etc.). The risks associated with the return shipment are borne by the Customer.
Any Item that has been worn, damaged or returned incomplete will be sent back to the Customer automatically and cannot be refunded.
10.3 Refund
After receiving and checking the return, MARAISLISE issues the refund within a maximum of 14 calendar days of receiving the returned parcel, using the payment method from the Order.
11. LEGAL GUARANTEES
11.1 Legal guarantee of conformity
In accordance with Articles L217-4 et seq. of the French Consumer Code, MARAISLISE is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The Customer has 2 years from delivery to take action. Defects appearing within 24 months of delivery are presumed to have existed at the time of delivery.
In the event of a lack of conformity, the Customer may choose between repair and replacement of the goods. If these options prove impossible or disproportionate, the Customer may obtain a price reduction or the cancellation of the sale with a full refund.
11.2 Guarantee against hidden defects
In accordance with Articles 1641 et seq. of the French Civil Code, MARAISLISE is bound by the guarantee against hidden defects that render the goods unfit for their intended use. Action arising from hidden defects must be brought within 2 years of discovering the defect. The Customer may choose to return the goods and have the price refunded, or keep the goods and have part of the price refunded.

12. CUSTOMER SERVICE

MARAISLISE undertakes to respond to any request within 48 working hours, Monday to Friday.
13. LIABILITY
MARAISLISE undertakes to describe the Items sold on the Site as accurately as possible. MARAISLISE cannot be held liable for any failure resulting from an event of force majeure, defined as an external, unforeseeable and irresistible event, including in particular: strikes, riots, war, natural disasters, epidemics, the inability to use transport or telecommunications networks, and governmental acts.
14. INTELLECTUAL PROPERTY
MARAISLISE is the exclusive holder of the intellectual property rights to all elements of the Site: structure, visual identity, design, text, images, software, databases, trademarks, logos and domain names.
Any reproduction, representation or exploitation of these elements without the prior written consent of MARAISLISE is strictly prohibited and constitutes an infringement punishable under the Intellectual Property Code.
15. AGREEMENT ON EVIDENCE
The Customer acknowledges that the Order recording systems constitute evidence of all transactions made between MARAISLISE and the Customer. The computerised data stored on MARAISLISE’s servers constitute evidence of acceptance of the T&Cs and of all transactions.
The Customer may print, download and keep a copy of the T&Cs at any time.
16. PROMOTIONAL OFFERS AND NEWSLETTERS
With the Customer’s prior agreement, MARAISLISE may send information about Items and promotional offers by email or SMS. The Customer can unsubscribe at any time by clicking the unsubscribe link in each email, by replying STOP by SMS, or from their account area.
17. PERSONAL DATA
As part of the use of the Site and the processing of Orders, MARAISLISE collects and processes personal data in accordance with the GDPR. To find out more, see our Privacy Policy available on the Site.
18. COOKIES
The Site uses cookies and trackers to ensure it works properly and to improve your experience. To find out more and set your preferences, see our Cookie Policy available on the Site.
19. AMENDMENTS TO THE T&Cs
MARAISLISE reserves the right to amend these T&Cs at any time. Only the T&Cs in force at the time the contract is concluded are enforceable against the Customer. The Customer consents to the new version by confirming a new Order.
20. APPLICABLE LAW, MEDIATION AND DISPUTES
These T&Cs are governed by French law.
In the event of a dispute, the Customer first contacts Customer Service at hello@maraislise.com to seek an amicable solution.
Failing an amicable agreement, the Customer may use mediation free of charge with the mediator MARAISLISE is affiliated with:

The Customer may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
Failing an amicable resolution, any dispute will be submitted to the competent courts in accordance with the applicable legal rules.
